Ballantine's True Music Fund Application Terms and Conditions
Definitions
These terms and conditions (the “Terms and Conditions”) govern your application for a Grant from the Fund as operated by the Promoter in partnership with SSS and carry the following definitions:
Brand – Ballantine's.
Closing Date – Midnight on 14th March 2025 in the United Kingdom.
Competitor – Any competitor of the Brand including but not limiting to businesses operating in the nightlife, alcohol, or beverage sectors.
Fund – The True Music Icons fund, an initiative to help individuals and organisations bring their dream music projects to life.
Notification – An email or telephone call to the Recipient by the Promoter and/or SSS.
Grant – The amount of the Fund to be awarded to a Recipient, ranging between £5,000 and £30,000.
Promoter – Chivas Brothers International Limited, a company registered in Scotland under company number SC646563 and with a registered office at Kilmalid, Stirling Road, Dumbarton, Scotland, G82 2SS.
Privacy Policy – The policy of the Promoter found at https://www.chivasbrothers.com/wp-content/uploads/2023/08/Corporate-Privacy-Policy-CBL-CBIL-14-Aug-2023.pdf
Project – The dream music project detailed in the application.
Recipient – An applicant who is awarded a Grant from the Fund.
SSS – shesaid.so Limited, a company registered in England and Wales under Company number 10635685.
Territory – Worldwide.
Full Terms and Conditions
Your application for a Grant from the Fund is governed by these Terms and Conditions. Any application instructions are deemed to form part of the Terms and Conditions and by applying for a grant you accept these Terms and Conditions and agree to abide by them, including any modifications.
The Promoter reserves the right to refuse to award the Grant to anyone in breach of these Terms and Conditions.
In the event of any conflict or inconsistency with any other communications, including advertising or promotional materials, these Terms and Conditions will prevail.
Who can enter (eligibility)
Application for a Grant is only open to residents in the Territory and entry must be submitted from within the Territory.
To apply you must:
be 25 years old or above;
be of legal drinking age in your country of residence;
be of legal age to apply for Grants in your country of residence;
have access to the internet;
have a valid passport; and
not be subject to any trade sanctions, embargoes, or other legal restrictions under EU, U.S., or international law.
How to enter
To apply you must access the website True Music Fund and follow the entry instructions before the Closing Date.
Applications must comply with these Terms and Conditions.
The following categories of people are not eligible to apply for a Grant:
Officers, directors and employees of the Promoter, its parents, subsidiaries, or affiliates.
Individuals or entities responsible for the development and implementation of this Fund, and any employees, officers or directors of any corporate body responsible for the same.
Employees working for suppliers, distributors and retailers of alcoholic beverage products.
Individuals who are employees of, or members of the immediate family or household of, any of the above categories.
Only one application per person is permitted. If more than one entry is received from the same person, all such further applications will be disqualified and only the first application will be accepted as an application for a Grant.
No applications from agents, third parties, syndicates, organised groups or applications automatically generated by a computer, program, application, script or any automatic method will be accepted.
No payment or purchase is necessary to enter or win as this is a free application process. A payment or purchase will not improve your chances of being successfully selected.
Applications received after the Closing Date will not be considered.
Only applications with Project start dates between 1st April 2025 and 15th December 2025 will be accepted.
Where the entry instructions require the submission or creation of any material (including but not limited to text, photography or videography) such material shall not include any reference to any person whether visual or written unless you have obtained consent for such use.
Projects must not promote any forms of political agenda, discriminatory content, or content that glorifies drug use.
Due to the Promoter’s commitment to promoting a message of responsible drinking, we require all entrants to be sensible, responsible and considerate when interacting with this application process. We will monitor any posted submissions to ensure that they comply with the Promoter’s corporate social responsibility policies, including ensuring that it does not feature someone who is or appears to be under the legal drinking age or is made by someone under the legal drinking age, encourages illegal, irresponsible or immoderate drinking.
Any application that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible and will be removed or destroyed by the Promoter.
Applications that are in breach of any of the above requirements will be disqualified and removed by the Promoter.
Incomplete, illegal, undelivered, stolen, misdirected or late applications will not be accepted regardless of cause, including, for example, because of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind. The Promoter will not accept responsibility for applications that are not received for such reasons. The Promoter cannot accept proof of transmission as proof of receipt.
The Promoter will not accept applications that are illegible, have been altered, reconstructed, forged or tampered with, that are photocopies and not originals or that are incomplete.
The Promoter shall be the sole judge of which applications are valid applications and the result of the award of the Grants is final.
The Promoter reserves the right at its sole and absolute discretion to disqualify any individual deemed to be ineligible, found to be attempting to circumvent the application process by tampering with its operation, setting up multiple accounts, using multiple identities or acting in a manner deemed by the Promoter to be in violation of the terms and conditions and, where necessary, to undertake all such action as is reasonable to protect itself against such fraudulent or invalid Applications including, without limitation, to require further verification as to the identity, age and other relevant details of an entrant and their entry.
The Promoter accepts no responsibility for failure or delay to receive an entry where such failure is due to circumstances outside the Promoter’s control.
By applying for a Grant, you confirm that you are eligible to do so and eligible to claim the Grant if you are a Recipient. The Promoter may require you to provide proof that you are eligible to apply and that your application complies with these Terms and Conditions and reserves the right to withhold an award of a Grant if you do not provide proof or if the evidence shows reason to believe that your entry does not comply with these Terms and Conditions.
Selecting the Recipient/s
Applications for Grants will first be reviewed by SSS. SSS will assess feasibility, effectiveness, the Project’s link to music and the fit with the Brand's purpose.
Only applications that successfully pass the initial screening by SSS will be forwarded to the Promoter for further evaluation.
The Promoter will evaluate the short-listed applications using predefined scores to identify their top 8 applications. The top 8 will be the Recipients.
The Recipient/s of the Grant shall be selected and contacted by the Promoter and/or SSS within 21 days after the Closing Date.
The Promoter will make reasonable efforts to contact the Recipient/s. The Promoter is not responsible for unsuccessful efforts to notify any potential Recipient/s.
To receive the Grant, each Recipient must respond to the Notification within 7 days of the initial notification and shall fulfil all requirements detailed in the Notification within this timeframe. Requirements which may be detailed within the message may include confirmation/proof of the Recipient’s identification and age and details of the address the Grant shall be sent to. If requested by the Promoter, the Recipient may be required to sign documentation as required by law in their country of residence following receipt of the Notification.
To receive the Grant, the Recipient may be required to execute further formal agreements with the Promoter and/or SSS.
For the avoidance of doubt, “initial notification” shall be taken to mean the first day on which the Notification is sent by the Promoter to a Recipient.
If a Recipient fails to respond to or fails to fulfil the requirements detailed by the Promoter in the Notification within the timeframe specified or they reject the Grant, the Recipient will be disqualified, the Grant forfeited and an alternative Recipient selected in the same manner as the original Recipient. If any prospective Recipient is found to be ineligible for any reason or non-compliant with these Terms and Conditions, it will result in disqualification and the Grant will be awarded to an alternative Recipient under the same terms as those set out above.
Participants are encouraged to check their email inbox regularly after the Closing Date to ensure that they do not miss the Notification from the Promoter.
Once a Recipient has fulfilled all requirements detailed in the Notification, delivery of the Grant shall be organised for that Recipient.
The Promoter must publish or make available information that shows that the Grants have been awarded. If you object to your surname, county or winning entry being published or made available, please contact the Promoter at Ballantines@pernod-ricard.com.
Grant
The Recipients shall each receive a Grant from the Fund.
The total Fund available is £100,000.
Each Recipient will receive a Grant based on their Project's scope and needs. Not all Grants will be of equal amount.
Each Recipient is responsible for assessing its tax implications and paying any tax due or owing on the Grant received.
No cash alternative is available for the Grant.
The Grant is not assignable or transferable. No transfers or substitutions are permitted except that the Promoter reserves the rights to substitute a Grant of equal or greater value due to unavailability or otherwise in its sole and absolute discretion.
The Grant may not be claimed by a third party on your behalf.
The decision of the Promoter regarding any aspect of the Grant is final and binding, and no correspondence will be entered about it.
Each Recipient will also receive a digital mentorship session.
Conditions of the Grant
The Recipient must use the Grant for the Project.
All costs related to the execution of the Project must be covered by the Grant. This includes, but is not limited to, ideation, production, promotion and any other associated costs (such as advertising and bookings).
The Recipient will not, without the prior written consent of the Promoter, during the term of the Project (or such other period as mutually agreed in writing), collaborate with or engage in sponsorship or partnership agreements with any brands that are a Competitor of the Brand.
The Recipient must make themselves available to work with the Promoter's PR and social media teams to promote the Project and the collaboration.
The Recipient will participate in up to three portrait shoots as part of the announcement of Recipients and execution phase (April 2025 and onwards).
The Recipient agrees portraits, along with their name, may be used by the Brand and SSS for promotional purposes on the website, social media, and other marketing channels of both the Brand and SSS.
The Recipient will be required to participate in a minimum of one meeting per month with their mentor and/or the Brand's/SSS team member from the ideation phase (May 2025 and onwards).
The Recipient grants to the Promoter a permanent, royalty-free licence on the Promoter’s standard terms to use the Project including but not limited to in relation to specific fields, such as for online marketing, social media, and other promotional activities.
General
You hereby confirm that all personal information submitted by you in applying for a Grant (the “Information”) is true and accurate. You are disclosing the Information to the Promoter for the application. The Promoter will only use the Information for the purpose of operating and administering the Grant (including, without limitation, sharing it with any third-party provider for the purposes of awarding and administering the Grant), and for the further purposes set out or referred to in the Privacy Policy.
As part of the application, you agree to granting the Promoter a permanent, royalty-free licence on the Promoter’s standard terms to use all images or other materials submitted to the Promoter by you. Ownership of the intellectual property rights in any images submitted shall vest in you. To be clear about what this means: if you win a Grant, you will own the materials you submitted, but we will be able to use them (e.g., by sharing them on social media) indefinitely.
The Promoter may ask you to participate in publicity relating to the Grant, and the Promoter will ask you to consent to any such publicity, which may include the use of your name and your country of residence on the Promoter’s website, Facebook, Twitter and Instagram accounts.
As far as is permitted by law, the Promoter assumes no responsibility or liability for any incorrect, incomplete or late applications, or for any faulty, incorrect, erroneous or failed electronic data transmissions.
The Promoter and its associated companies, agents, contractors and sponsors, to the fullest extent permitted by law, assume no liability whatsoever for any direct or indirect damage, loss, or any injury suffered by any applicant or guest of any applicant (where applicable) applying for a Grant and/or as a result of accepting the Grant.
In the event of exceptional circumstances outside its reasonable control, the Promoter reserves the right to hold void, cancel or amend the Fund or these Terms and Conditions at any stage but will always endeavour to minimise the effect on entrants to avoid undue disappointment.
The Promoter’s selection of the Recipient/s is binding in all matters.
The Fund is void where prohibited or restricted by law.
If any provision of these Terms and Conditions is determined to be illegal, invalid or otherwise unenforceable, then it shall be severed and deleted from these Terms and Conditions, and the remaining clauses shall survive and remain in full force and effect.
The Fund and these Terms and Conditions (and any non-contractual issues which arise out of or in connection with them) will be governed by the laws of the participating country, but any dispute as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the English courts.
